Biography
Ubaldo M. Fernández-Barrera is a Member in the Litigation Department of O’Neill & Borges LLC. Ubaldo has close to 20 years of experience in commercial litigation, bankruptcy proceedings, and proceedings in state and federal agencies. His practice includes litigation related to creditor’s rights, antitrust, distribution and franchising law, securities litigation, and general commercial law. Ubaldo represents clients by assessing and developing an effective and aggressive litigation strategy that is tailored to the client’s objective.
His bankruptcy practice focuses on the representation of creditors and other stakeholders in proceedings under Chapter 7, 11 and 12 of the Bankruptcy Code, including objections to confirmations of plans of reorganization, and the representation of the Financial Oversight and Management Board (FOMB) within the Title III proceedings under PROMESA.
Ubaldo has extensive experience in securities litigation in state and federal courts where he has successfully represented brokerage firms, financial advisors and executive officers in high stakes derivative suits and other claims filed by investors. His experience also includes representation of firms and brokers before the Financial Regulatory Authority (FINRA) since the beginning of his career and before the Courts regarding award confirmation and expungement proceedings. Ubaldo has also represented highly regulated clients in investigations proceedings before various agencies including the Consumer Financial Protection Bureau (CFPB).
Ubaldo’s litigation in state and federal courts regarding creditor’s rights and distribution agreements has included the representation of clients in handling requests for injunctions, dispositive motions and trial. Ubaldo has successfully represented clients in Court injunctive proceedings and at trials in both state and federal courts. Ubaldo also has extensive experience representing clients in pursuing claims and trials against insurance carriers in state and federal courts.
Ubaldo has been recognized as a leading insolvency lawyer by Best Lawyers®. He holds a Bachelor’s Degree in Government and French from Georgetown University and obtained his Juris Doctor from Interamerican University of Puerto Rico.
