Biography
Hermann D. Bauer-Álvarez is a Member of the Litigation Department at O’Neill & Borges LLC, where he focuses his practice on bankruptcy, restructuring, and creditors’ rights in Puerto Rico. Since joining the firm in 1998, he has represented institutional lenders, investors, funds, and business enterprises in complex bankruptcy and non-bankruptcy matters, including loan restructurings, adversary proceedings, and insolvency-related litigation. His practice also encompasses general commercial disputes, distressed-asset transactions, and anti-bankruptcy advisory work for clients navigating financially troubled portfolios.
Recognized by Chambers Latin America and Chambers Global for his expertise in bankruptcy and restructuring, Mr. Bauer is regarded for his depth of experience and strategic command of Puerto Rico’s insolvency landscape. He has investigated and litigated a wide array of matters involving lender liability, fraud, distress, and insolvency issues through trial and appeal, and has played a central role in major restructurings and Chapter 11 proceedings involving high-profile debtors and lenders before the U.S. Bankruptcy Court for the District of Puerto Rico and other jurisdictions.
Beyond bankruptcy, Mr. Bauer maintains an active commercial and corporate litigation practice before Puerto Rico and federal courts, handling disputes under the Puerto Rico Dealer’s Act (Law 75), the Sales Representatives Act (Law 21), and complex commercial contract, trade regulation, and intellectual property matters, including RICO, bank fraud, Lanham Act, and Puerto Rico trademark claims. His broad experience enables him to guide clients seamlessly through intertwined bankruptcy and commercial litigation risks.
Mr. Bauer holds a Juris Doctor from the University of Puerto Rico School of Law (1998) and a B.A. from Goshen College (1995). He is admitted to practice in Puerto Rico and before the U.S. District Court for the District of Puerto Rico. In addition to his practice, he has lectured on Bankruptcy Law at the University of Puerto Rico School of Law and frequently serves as a panelist in professional seminars and symposiums on bankruptcy and restructuring.
