Privacy, Cybersecurity, Social Media, and Digital Workplace

Technology is constantly evolving. Existing, new, and emerging technologies adopt to a constantly emerging regulatory framework. As a result of the continuous evolution of technology and social media, and the incorporation of these resources in enterprises’ daily business practices, there has been an increased litigation of cases involving cybersecurity, confidential information, trade secrets, privacy rights, concerted activities, cyber harassment, intellectual property rights, data protection, and the like.

From a regulatory perspective, our Firm’s Privacy and Cybersecurity team assists clients with their compliance with the local privacy and data protection requirements to ensure proper consent is obtained from local consumers. This includes providing advice on local privacy policy and notice requirements, data collection, storage, and use of consumer personal information, and compliance with local data breach statutes.  In this area we have assisted multinational companies in the retail, banking, health, automobile manufacturing, and entertainment industries with important privacy and cybersecurity incidents, including data breaches that have impacted local residents.

We provide counseling on the applicable state and federal privacy and data protection laws, as well as assist them in the development and implementation of appropriate policies to regulate telecommuting and the use of these ever-changing technologies and media outlets in the workplace, such as social media, e-mail, data loss prevention software, internet monitoring programs, among others. We also counsel clients, in the preparation and implementation of data preservation rules, responses to litigation hold requests, cybersecurity litigation, and e-discovery.
