Pedro Delgado-Hernández is a member in the Labor and Employment Law Department. He joined O'Neill & Borges LLC in 1986. From 1984 to 1986, Mr. Delgado-Hernández clerked for the Honorable Juan R. Torruella, Chief Judge of the United States District Court for the District of Puerto Rico and, from November 1984, Judge (formerly Chief Judge) of the United States Court of Appeals for the First Circuit. From 1993 to 1995, Mr. Delgado-Hernández served as Solicitor General of the Commonwealth of Puerto Rico. In 1995, Mr. Delgado-Hernández was appointed judge of the Puerto Rico Court of Appeals, where he served until 1996, at which time he returned to the Firm.
Mr. Delgado-Hernández counsels and represents employers in various employment related areas, including discrimination, dismissals, medical leaves of absence, employment torts, sexual harassment, reductions- in- force and plant closings.
Representative cases include: Nazario v. Nypro Puerto Rico, 2003 U.S. Dist. LEXIS 15040 (D.P.R. 2003); Santiago v. Lloyd, 66 F.Supp. 2d 282 (D.P.R. 1999)(sexual harassment); Landrau v. Caribbean Restaurants, 14 F.Supp.2d 185 (D.P.R. 1998)(applying the Faragher defense to sexual harassment claims under Puerto Rico law); Morales-Narváez v. Rosselló, 1995 U.S. App. LEXIS 26064 (1st Cir. 1995)(injunctions; political discrimination); Rivera-Cotto v. Rivera, 38 F.3d 611(1st Cir. 1994)(disability and political discrimination); Charles v. Rice, 28 F.3d 1312 (1st Cir. 1994)(disability discrimination); López Campos v. Garage Isla Verde, 126 D.P.R. 166 (1990)(sexual harassment).
