PROFILE


Mr. Valldejuly is the head of the Litigation Department. He has been with O'Neill & Borges since 1992, and has served as the Firm’s Managing Partner and as a member of its Executive Committee.

Mr. Valldejuly has substantial experience in civil and commercial litigation involving a wide array of complex legal issues at the Federal Courts, the Puerto Rico local courts and administrative agencies, and has also participated in significant commercial arbitration proceedings. He has extensive experience in distribution and marketing matters, particularly in cases relating to the Puerto Rico's dealer and sales representatives' protection statutes (i.e., Law 75 and Law 21). Mr. Valldejuly’s litigation practice also covers other trade regulation areas (such as price discrimination and other antitrust issues), mass torts, and environmental litigation, among other types of commercial litigation.

Mr. Valldejuly also counsels clients in the merchant community, helping major retailers to address the ever-present challenges of doing business in Puerto Rico (including dealing with DACo regulations and other government affairs).

Mr. Valldejuly has been recognized by Chambers and Partners as one of the leading dispute resolution attorneys in Puerto Rico. He takes pride in working very closely with clients to develop tailor-made strategies to achieve the desired results in a cost-effective manner, and also provides preventive counseling to the Firm’s clients, as appropriate.

Mr. Valldejuly is also very involved with the Federal Bar Association and was elected President of the FBA’s Puerto Rico Chapter, which is one of the largest in the U.S. He is also a Fellow of the Foundation of the Federal Bar Association.

Representative cases include: Southwire Company v. Ramallo Bros. Printing, 2008 U.S Dist. LEXIS 19250 (D.P.R.)(No dismissal of CERCLA lawsuit based on statement in criminal plea agreement.); Southwire Company v. Ramallo Bros. Printing, 2006 U.S. Dist. LEXIS 92926 (D.P.R.)(plaintiffs sufficiently laid out a case under the CERCLA provisions and cause of action was found viable even if plaintiff had not been previously sued as a result of the contamination; RCRA claim for injunctive relief also valid); Ford Motor Credit Co. of P.R. v. Caribe Ford, Inc., 247 F. Supp. 2d 118 (D.P.R. 2003)(establishing the test for citizenship of a corporation); Charlie Auto Sales, Incorporated / Hyundai de Bayamón v. Mitsubishi Motor Sales of Caribbean, 84 F. Supp. 2d 249 (D.P.R. 1999)(dealership agreement subject to arbitration provision; antitrust claim dismissed).
